1. What is Klarna

Klarna Bank AB (publ), headquartered in Stockholm, Sweden, is a credit institution regulated and authorised to operate within the European Economic Area. Pistacho offers Klarna as an alternative payment method in the Online Shop, allowing the Customer to choose, from the eligible options available at any given time:

  • Pay in 3 interest-free instalments (Pay in 3);
  • Pay later (invoiced up to 30 days after purchase);
  • Other financing plans that Klarna may make available.

Eligibility for each option and the maximum financeable amount depend solely on Klarna and may be refused at its discretion.

2. Who is the Customer's counterparty

When the Customer chooses to pay with Klarna:

  • The purchase and sale contract continues to be concluded between the Customer and Pistacho (Pistacho is the seller of the products);
  • The payment, credit or financing contract is concluded between the Customer and Klarna, governed by Klarna's own terms and conditions, available at www.klarna.com/pt/termos-e-condicoes.

There are therefore two legally distinct contracts, with different parties and responsibilities.

3. How payment works

  1. At checkout, the Customer selects Klarna as the payment method and chooses the desired option.
  2. They are redirected to the Klarna environment, where they provide the data required for assessment.
  3. Klarna carries out an automated assessment (including, where applicable, consultation of credit reference agencies) and communicates the decision.
  4. Once the transaction is approved, Pistacho receives the sale amount directly from Klarna and processes the order in the usual way.
  5. The Customer then pays Klarna according to the agreed plan, with Klarna being responsible for collecting the instalments.

4. Personal data processing

In order for the Klarna payment to be processed, certain personal data must be shared between Pistacho and Klarna, namely:

  • Customer identification and contact details (name, NIF, address, email, phone number);
  • Order details (products, amount);
  • Delivery details.

Klarna processes this data as an independent data controller, pursuant to its Privacy Notice available at cdn.klarna.com/…/privacy. Pistacho does not control and is not responsible for the processing of data carried out by Klarna after sharing.

The legal basis for sharing is the performance of the purchase and sale contract concluded by the Customer (art. 6(1)(b) GDPR) and compliance with the obligations arising therefrom.

5. Returns and refunds with Klarna

In the event of a return or exercise of the right of withdrawal (see Exchanges and Returns Policy), the following applies:

  • The Customer communicates the return to Pistacho through the usual channels;
  • Pistacho notifies Klarna as soon as the return is validated;
  • The refund is made by Klarna to the Customer according to its rules (generally: cancellation of outstanding instalments and refund of amounts already collected);
  • Until Pistacho validates the return, the Customer must continue to meet their payment obligations to Klarna, failing which they may incur charges with Klarna. Klarna usually offers a “pause” feature in its app/portal — notwithstanding this, the Customer is solely responsible for managing their relationship with Klarna.

6. Consumer rights preserved

The choice of Klarna as a payment method does not affect the Customer's rights vis-à-vis Pistacho, namely:

  • The 14-day right of withdrawal under DL 24/2014 (subject to applicable legal exceptions);
  • The 3-year statutory guarantee of conformity provided for in DL 84/2021;
  • The right to submit a complaint in the Complaints Book.

These rights are in all cases exercised against Pistacho, not against Klarna.

7. Disputes and complaints relating to Klarna

Complaints relating to the Klarna payment or financing service (charges, instalments, credit decisions, personal data processed by Klarna) must be directed to Klarna through the channels indicated at www.klarna.com/pt. Complaints relating to the product or sales service must be directed to Pistacho.

Klarna is supervised by the Swedish financial supervisory authority (Finansinspektionen) and, in Portugal, by the Banco de Portugal, within the scope of their respective powers.

8. Costs

The Pay in 3 option is generally interest-free for the Customer, provided payment deadlines are met. For instalment financing options, interest and charges may apply, communicated transparently by Klarna prior to contracting. Any late payment or default fees are likewise the Customer's responsibility to Klarna.

9. Service availability

Pistacho may, at any time, suspend or discontinue the availability of Klarna as a payment method. The Customer's eligibility for each option is decided unilaterally by Klarna and does not bind Pistacho.
