1. Identification and scope
This document sets out the General Terms and Conditions, hereinafter “T&C”, applicable to all purchases made at www.pistachodecor.com, hereinafter “Online Store”, operated by Pistacho, Arquitectura e Interiores, Lda., legal entity no. 516 848 780, with registered office at Rua Vale de Sá, n.º 1, 3050-106 Santa Luzia, Mealhada, hereinafter “Pistacho”, “we” or “Seller”.
Use of the Online Store and placement of any order implies full and unreserved acceptance of these T&C, the Privacy and Cookies Policy and all other policies published on the website. The Customer declares that they are 18 years of age or older and have full legal capacity to enter into contracts.
Pistacho is the sole seller to the Customer, even in cases where the product is supplied or shipped directly by a partner supplier, see section 3 — Production and supply model. All Customer rights, namely the legal guarantee and the right of withdrawal, are exercised before Pistacho.
2. Products
The Online Store sells:
Furniture produced by Pistacho, catalogue pieces and made-to-measure pieces, all manufactured after order confirmation, in our carpentry workshop or through our network of production partners;
Decoration and accessories from partner brands, shipped directly by the supplier;
Complementary services associated with purchased products, for example, stain-resistant treatments, waterproofing, assembly and delivery to the floor, among others.
The products available at any given time are presented with a description, illustrative photograph, price, essential characteristics and delivery or execution timeframe. Colours, textures and dimensions may show slight differences from the image due to screen display limitations, the nature of the materials, wood, textiles, handmade pieces, or different production batches. These variations do not constitute a product defect.
3. Production and supply model
3.1. Products produced by Pistacho
Pistacho products are made to order in our carpentry workshop or through our network of production partners — we do not keep stock of these products. Regardless of the place of production, Pistacho is the Customer’s sole point of contact and is responsible for product conformity. The maximum production and delivery period is 120, one hundred and twenty, business days from confirmation and payment of the order, see section 5. Each product page indicates the estimated production period, within this maximum limit.
By finalising the order, the Customer expressly accepts this extended timeframe by validating the specific checkbox made available at checkout.
3.2. Products from partner brands, direct shipping by the supplier
Certain decoration and accessory products from partner brands are shipped directly by the respective supplier to the Customer’s delivery address. The delivery times for these products are those applied by each supplier, as a rule, between 30 and 60 business days, depending on the supplier and stock availability, and are indicated on the respective product page before order confirmation.
Pistacho retains the status of seller of these products before the Customer: the contract is concluded with Pistacho and the Customer’s rights, legal guarantee, return, conformity, refunds, are exercised before Pistacho. The supplier’s involvement is merely logistical.
3.3. Mixed orders
Orders combining Pistacho products and products from partner suppliers may be delivered in separate shipments, with different timeframes. Each product is delivered as soon as it is ready, unless otherwise indicated by the Customer.
4. Prices
All prices displayed are expressed in euros, €, and include VAT at the applicable legal rate. Prices do not include transport, assembly or other complementary service costs, which will be clearly indicated before order confirmation.
Pistacho reserves the right to change, at any time, the prices displayed in the Online Store. The prices applicable to each order are those shown on the website at the time of order confirmation.
In the event of a manifest pricing error, for example, a price incompatible with the product’s actual market value, Pistacho will inform the Customer and propose cancellation of the order or its maintenance at the corrected price, at no cost to the Customer.
5. Payment
5.1. Methods
The Online Store accepts the following payment methods: Multibanco, MB Way, Payshop, credit and debit cards, Visa, Mastercard, Apple Pay, Google Pay and Klarna in the modalities available at any given time, see Klarna Payment Policy. Payments are processed in a secure environment, SSL/TLS, through Ifthenpay, Lda., Multibanco, MB Way, Payshop, and Shopify Payments, credit/debit cards, Apple Pay, Google Pay and Klarna.
5.2. Pistacho products — full payment
All orders, including Pistacho products made to order, are paid in full, 100%, at the time of checkout. No deposit and remaining balance system is applied. Full payment confirms the order and marks the start of the production period.
5.3. Products from partner brands
Products from partner brands are paid in full at the time of order confirmation, unless otherwise indicated for each product.
5.4. Invoicing
For each order, an electronic invoice is issued under Portuguese tax law and sent to the email address provided by the Customer. The invoice is issued for the total value of the order. The Customer is responsible for the accuracy of the billing details provided, including the Tax ID, where applicable.
6. Order process
The conclusion of the distance purchase and sale contract follows these steps:
Selection of products and addition to the cart;
Validation of shipping and billing details;
Acceptance of the T&C, Privacy Policy and other applicable policies;
Express acceptance of the extended production period, if the order includes Pistacho products;
Full payment of the order;
Final confirmation, “Complete order” or equivalent button, identified as an obligation to pay;
Sending of an order confirmation email with the respective number and description.
The contract is considered concluded when Pistacho sends the confirmation email to the Customer. Pistacho reserves the right not to accept or to cancel orders in cases of unavailability of the material necessary for production, suspected fraud, breach of the T&C or technical impossibility of fulfilment, in which case any amount paid will be refunded.
7. Delivery
Delivery conditions are described in the Shipping Policy, which forms an integral part of these T&C.
8. Right of withdrawal, exchanges and returns
The Customer, as a consumer, has the right to withdraw from the contract under Decree-Law no. 24/2014 of 14 February, as detailed in the Exchanges and Returns Policy. The exclusions provided for by law apply, in particular regarding customised goods and services already fully performed, as described in the Customisation Policy.
The fact that a product is made to order does not, in itself, imply the loss of the right of withdrawal: this right is only lost when the product is made according to specifications provided by the Customer or is manifestly customised.
9. Legal guarantee of conformity
All goods sold benefit from the legal guarantee of conformity of 3, three, years from the date of delivery, under Decree-Law no. 84/2021 of 18 October. In the event of a lack of conformity, the Customer may choose, in the order provided by law, to restore conformity through repair or replacement of the good, proportional price reduction or termination of the contract. During the first 2 years, it is presumed that the lack of conformity already existed on the date of delivery.
The guarantee covers all products sold in the Online Store, including those from partner brands shipped by the supplier, with Pistacho being the Customer’s counterparty for the purposes of exercising the guarantee.
The legal guarantee does not cover damage resulting from improper use, normal wear and tear, exposure to excessive humidity or temperature, poor maintenance or intervention by unauthorised third parties.
10. Intellectual property
All content made available in the Online Store — texts, images, photographs, illustrations, designs, trademarks, logos, source code and page structures — is the property of Pistacho or of third parties who have authorised its use, and is protected by the applicable legal regimes on intellectual and industrial property. Its reproduction, distribution, public communication, transformation or any other form of use is prohibited without Pistacho’s prior, express and written authorisation.
11. Liability
Pistacho is liable for the conformity of the goods and for the provision of the contracted services under the terms of the law. However, it is not liable for:
Interruptions, technical failures or unavailability of the Online Store due to causes attributable to third parties or force majeure;
Indirect damages, loss of profits or other purely economic losses without a direct causal link to the breach;
Improper use of the products by the Customer, contrary to the instructions provided.
12. Dispute resolution
The applicable conditions are set out in the Dispute Resolution Policy and in the reference to the Electronic Complaints Book, available in a separate document.
13. Applicable law and jurisdiction
These T&C are governed by Portuguese law. For the resolution of any dispute arising from their application or interpretation, and without prejudice to mandatory rules on consumer protection, the parties elect the jurisdiction of the District Court of Aveiro, with express waiver of any other.
14. Amendments
Pistacho reserves the right to amend these T&C at any time. Amendments enter into force on the date of their publication in the Online Store. Contracts already concluded are governed by the T&C in force on the date of order confirmation.
