1. Identification and scope
This document sets out the General Terms and Conditions (hereinafter “T&C”) applicable to all purchases made on www.pistachodecor.com (hereinafter the “Online Shop”), operated by Pistacho, Arquitectura e Interiores, Lda., legal person no. 516 848 780, with registered office at Rua Vale de Sá, n.º 1, Santa Luzia, 3050-106 Mealhada (hereinafter “Pistacho”, “we” or “Seller”).
Use of the Online Shop and the placing of any order implies full and unreserved acceptance of these T&C, of the Privacy and Cookies Policy and of the other policies published on the website. The Customer declares that they are 18 years of age or over and have full legal capacity to enter into contracts.
Pistacho is the sole seller to the Customer, even where the product is supplied or shipped directly by a partner supplier (see section 3 — Production and supply model). All the Customer’s rights, namely the legal guarantee and the right of withdrawal, are exercised against Pistacho.
2. Products
The Online Shop sells:
- Furniture made by Pistacho (catalogue pieces and made-to-measure pieces), all made after confirmation of the order, in our workshop or through our network of production partners. Delivery and assembly of the furniture are free in mainland Portugal, and assembly is carried out by Pistacho on the day of delivery;
- Lighting (lamps), decoration and accessories from partner brands, shipped directly by the supplier;
- Complementary services associated with products purchased (for example, stain-resistant and waterproofing treatments, among others).
The products available at any given time are presented with a description, illustrative photograph, price, main characteristics and delivery or production lead time. Colours, textures and dimensions may differ slightly from the image owing to on-screen display limitations, the nature of the materials (wood, textiles, handcrafted pieces) or different production batches. Such variations do not constitute a defect in the product.
2.1. Product images
The product images shown in the shop, including three-dimensional renders and room-setting photographs, are purely illustrative. There may be slight variations in colour, tone, grain or texture between the images and the final product, arising from the production process, the natural characteristics of the materials (woods, fabrics, lacquers) and the display settings of the customer’s device. These variations are inherent to made-to-order pieces and do not constitute a lack of conformity of the product.
3. Production and supply model
3.1. Products made by Pistacho
Pistacho products are made to order in our workshop or through our network of production partners — we do not hold stock of these products. Regardless of the place of production, Pistacho is the Customer’s sole point of contact and is responsible for the conformity of the product.
Each product page states, before the order is confirmed, the production lead time for that piece (2 weeks for benches and for coffee, side and bedside tables; 3 weeks for beds, sofas and dining tables; 4 weeks for sideboards and TV units; 6 weeks for shelving units), plus one week for delivery and assembly. The lead time runs from confirmation and payment of the order. In the event of unforeseen circumstances, the maximum production and delivery period is 120 (one hundred and twenty) working days from confirmation and payment of the order (see section 5).
On completing the order, the Customer expressly accepts this maximum period by ticking the specific box provided at checkout.
3.2. Partner-brand products (shipped directly by the supplier)
Certain lighting, decoration and accessory products from partner brands are shipped directly by the respective supplier to the Customer’s delivery address. The delivery lead time for each of these products is stated on the respective product page, before confirmation of the order (for lamps, currently 2 to 4 weeks, plus one week for delivery).
Pistacho remains the seller of these products to the Customer: the contract is entered into with Pistacho and the Customer’s rights (legal guarantee, returns, conformity, refunds) are exercised against Pistacho. The supplier’s involvement is purely logistical.
3.3. Mixed orders
Orders combining Pistacho products and products from partner suppliers may be delivered in separate shipments, with different lead times. Each product is delivered as soon as it is ready, unless the Customer indicates otherwise.
4. Prices
All prices shown are expressed in Euros (€) and include VAT at the legal rate in force.
Delivery and assembly of furniture are free to any address in mainland Portugal. Assembly is carried out by Pistacho on the day of delivery and does not apply to lamps or to other partner-brand products. For the Azores and Madeira, transport of furniture is quoted on a case-by-case basis.
Furniture prices include delivery and assembly in mainland Portugal. Product prices do not include shipping costs for partner-brand lamps or other complementary services, which are shown prominently in the basket, before the order is confirmed, in accordance with the Shipping Policy (namely, separate shipping charges for partner-brand lamps: free for Zambelis; €8 for Nordlux on orders below €307.50).
Pistacho reserves the right to change the prices shown on the Online Shop at any time. The prices applicable to each order are those shown on the website at the time the order is confirmed.
In the event of a manifest pricing error (for example, a price inconsistent with the real market value of the product), Pistacho will inform the Customer and propose either cancellation of the order or its continuation at the corrected price, at no cost to the Customer.
5. Payment
5.1. Methods
The Online Shop accepts the following payment methods: Multibanco, MB Way, credit and debit cards (Visa, Mastercard), Apple Pay, Google Pay and Klarna, in the options available at any given time (see Klarna Payment Policy). Payments are processed in a secure environment (SSL/TLS) through Shopify Payments (credit and debit cards, Apple Pay, Google Pay and Klarna) and Ifthenpay, Lda. (Multibanco and MB Way).
5.2. Pistacho products — payment in full
All orders, including made-to-order Pistacho products, are paid in full (100%) at the time of checkout. No deposit-and-balance arrangement is offered. Payment in full confirms the order and marks the start of the production lead time.
5.3. Partner-brand products
Partner-brand products are paid in full at the time the order is confirmed, unless otherwise stated for each product.
5.4. Invoicing
An electronic invoice is issued for each order in accordance with Portuguese tax legislation and sent to the email address provided by the Customer. The invoice is issued for the total value of the order. The Customer is responsible for the accuracy of the billing details provided, including NIF (tax identification number), where applicable.
6. Ordering process
The distance sales contract is concluded through the following steps:
- Selection of products and addition to the basket;
- Validation of shipping and billing details;
- Acceptance of the T&C, Privacy Policy and other applicable policies;
- Express acceptance of the maximum production period (where the order includes Pistacho products);
- Payment of the order in full;
- Final confirmation (“Complete order” or equivalent button, identified as an obligation to pay);
- Sending of an order confirmation email with the respective number and description.
The contract is deemed concluded when Pistacho sends the order confirmation email to the Customer. Pistacho reserves the right not to accept or to cancel orders in cases of unavailability of the material required for production, suspected fraud, breach of the T&C or technical impossibility of performance, in which case any amount paid will be refunded.
7. Delivery
The delivery and assembly conditions are set out in the Shipping Policy, which forms an integral part of these T&C. Deliveries are made in mainland Portugal; for the Azores and Madeira, transport of furniture is quoted on a case-by-case basis.
8. Right of withdrawal, exchanges and returns
The Customer, as a consumer, has the right of withdrawal from the contract within 14 days, under Decreto-Lei n.º 24/2014, de 14 de fevereiro (Decree-Law No. 24/2014 of 14 February), as detailed in the Exchanges and Returns Policy. For standard catalogue furniture, the cost of returning the goods is borne by Pistacho. The exclusions provided for by law apply, in particular regarding personalised goods and services already fully performed, as described in the Customisation Policy.
The fact that a product is made to order does not, in itself, entail loss of the right of withdrawal: this is lost only where the product is made in accordance with specifications provided by the Customer or is clearly personalised.
9. Legal guarantee of conformity
All goods sold benefit from a 3 (three) year guarantee (legal guarantee) of conformity, from the date of delivery, under Decreto-Lei n.º 84/2021, de 18 de outubro (Decree-Law No. 84/2021 of 18 October). In the event of a lack of conformity, the Customer may choose, in the order provided for by law, to have conformity restored through repair or replacement of the goods, a proportionate reduction of the price or termination of the contract. During the first 2 years, the lack of conformity is presumed to have existed at the date of delivery.
The guarantee covers all products sold on the Online Shop, including partner-brand products shipped by the supplier, with Pistacho being the Customer’s counterparty for the purposes of exercising the guarantee.
The legal guarantee does not cover damage resulting from improper use, normal wear and tear, exposure to excessive humidity or temperature, inadequate maintenance or intervention by unauthorised third parties.
10. Intellectual property
All content made available on the Online Shop — texts, images, photographs, illustrations, designs, trade marks, logos, source code and page structures — is the property of Pistacho or of third parties who have authorised its use, and is protected by the applicable legal regimes on intellectual and industrial property. Its reproduction, distribution, public communication, transformation or any other form of use without the prior, express and written authorisation of Pistacho is prohibited.
11. Liability
Pistacho is liable for the conformity of the goods and for the performance of the contracted services under the law. However, it is not liable for:
- Interruptions, technical failures or unavailability of the Online Shop due to causes attributable to third parties or to force majeure;
- Indirect damage, loss of profits or other purely economic losses with no direct causal link to the breach;
- Improper use of the products by the Customer, contrary to the instructions provided.
12. Dispute resolution
The applicable conditions are set out in the Dispute Resolution Policy and in the reference to the Livro de Reclamações Eletrónico, available in a separate document.
13. Governing law and jurisdiction
These T&C are governed by Portuguese law. For the resolution of any dispute arising from their application or interpretation, and without prejudice to mandatory consumer protection rules, the parties choose the courts of the Comarca de Aveiro, with express waiver of any other.
14. Amendments
Pistacho reserves the right to amend these T&C at any time. Amendments take effect on the date of their publication on the Online Shop. Contracts already concluded are governed by the T&C in force at the date of confirmation of the order.
